Shoplifting is a particular type of theft in which an individual steals items from a retail store. With the exception of organized shoplifting groups, shoplifting is generally an impulsive act of low-value items. Most often, a person found to be shoplifting will be charged with theft under $5,000.
In order to be convicted of shoplifting, the Crown will have to prove a number of elements including the fact that you intended to shoplift. Many times, people become distracted while shopping by their children or a phone call and inadvertently walk out of the store without paying. In those situations, the individual did not form the necessary intent to shoplift and could not be convicted.
Alternative Measures Program
In certain circumstances, an accused person may have their shoplifting charge withdrawn by entering into the Alternative Measures Program. This is a program that diverts offenders from the traditional court system and upon completing certain conditions such as counselling or community service, the theft charge is withdrawn leaving the accused with no criminal record.
