Criminal harassment, or “stalking”, as it is commonly referred to, consists of repeated behavior that has the intention of harassing, frightening, annoying, or other actions displaying obsessive and unwanted conduct directed towards another individual without lawful authority.
There are four types of conduct that constitute criminal harassment if they cause the other person to reasonably fear for their safety or the safety of anyone known to them:
- Repeatedly following from place to place the other person or anyone known to them;
- Repeatedly communicating with, either directly or indirectly, the other person or anyone known to them;
- Besetting or watching the dwelling-house, or place where the other person, or anyone known to them, resides, works, carries on business or happens to be; or
- Engaging in threatening conduct directed at the other person or any member of their family.
There is no set number of incidents to define “repeatedly” other than the conduct must be overly frequent in the circumstances.

Peace Bond
Depending on the severity of the allegations, an accused may enter into a Peace Bond in which they are bound by certain conditions such as counselling and no contact with the complainant. Upon signing the Peace Bond, the criminal charges are withdrawn and the accused person is left with no criminal record. A Peace Bond is not a finding of guilt.
